Information Collected and Used by GOWEXPersonal Information. You may be required to provide personally identifiable information when registering an account with GOWEX, ordering Services, or requesting information about Services. This information is also used to manage the internal operations and security of our Social Networking Site Information. When you use of the Service, you allow GOWEX access and store certain information from Facebook or other Social Networking Sites (“SNS”) account.
Such information may include, but is not limited to your:
Profile picture or its uniform resource locator (“URL”);
User ID number, which is linked to publicly available information such as name and
User ID numbers and other public data for your friends;
Login e-mail address you provided to Facebook or other SNS;
Physical location and that of your access devices;

Use and Disclosure of Information GOWEX may use or disclose your personal information, social networking site information, and non-personal information: (i) to provide you enhanced services; (ii) to market to you services or products among the categories of services or products you currently subscribe; (iii) to protect the confidentiality or security of your records; (iv) comply with law enforcement, government mandate or other legal requirements; (v) our attorneys, accountants, and regulators; (vi) in connection with a sale, acquisition or merger of GOWEX or our assets or (vii) for other legally permissible purposes. Customer Proprietary Network Information ("CPNI"). To the extent voice services are offered, GOWEX is committed to the protection of its your CPNI and full compliance with the FCC’s CPNI rules. “CPNI” refers to information related to your telecommunications services account, such as to whom, where and when you make calls. Specific federal laws and regulations protect CPNI. Absent your consent, we will only share or disclose CPNI (i) to market to you services or products among the categories of services or products you currently subscribe, (ii) to initiate, render, bill and collect our telecommunications services, (iii) to protect you or other carriers from illegal or fraudulent use of, or subscription to, our services or to protect our rights or property, and (iv) for other legally permissible purposes.
Access to Personally Identifiable Information Except as set forth in this policy or otherwise specifically disclose it to you, any personally identifiable information gathered on the GOWEX website will not be made available to third-parties companies for purposes unrelated to the business of providing Services.

Introduction: This is a legally binding agreement between you (“End User” or “you”) and GOWEX USA LLC and its affiliates or subsidiaries (collectively, “GOWEX”) for use of GOWEX’s wireless local area network communications (“Wi-Fi”) service (the “Service”). You must be at least thirteen (13) years old to use the Service. By establishing an account and/or by using or activating the Service, End User agrees to be bound by this Agreement and to use the Service according to the terms of this Agreement and other policies posted on the GOWEX website, including our Privacy Policy and Acceptable Use Policy. PLEASE CAREFULLY REVIEW THIS AGREEMENT.
IMPORTANT NOTICE: BY USING GOWEX’S SERVICE, YOU AGREE TO BE BOUND BY AND COMPLY WITH THE TERMS AND CONDITIONS IN THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS PROVIDED IN THIS AGREEMENT, DO NOT USE OR ACTIVATE THE SERVICE. IN THE EVENT THAT ONE OR MORE PROVISIONS OF THIS AGREEMENT IS, FOR ANY REASON, HELD INVALID, ILLEGAL, OR UNENFORCEABLE, SUCH INVALIDITY, ILLEGALITY, OR UNENFORCEABILITY SHALL NOT AFFECT ANY OTHER PROVISION CONTAINED IN THIS AGREEMENT, WHICH SHALL REMAIN VALID AND ENFORCEABLE. YOU ACKNOWLEDGE THAT NEITHER THE INDEPENDENT THIRD PARTY MERCHANTS, NOR ANY EMPLOYEE OF GOWEX OR ANY OTHER AGENT IS AUTHORIZED TO MAKE ANY REPRESENTATION OR WARRANTY (OTHER THAN AS DESCRIBED IN THIS AGREEMENT OR OUR CURRENT MATERIALS) WITH RESPECT TO THE AGREEMENT, THE SERVICE OR TO WAIVE OR MODIFY ANY TERMS OR PROVISIONS OF THE AGREEMENT.
Description of Service. The Service provides you with free access to the Internet via certain Internet access points (“hotspots”) hosted by independent third party merchants (“Merchant Venues”) together forming a network managed by GOWEX (the “We2 Network”). Primarily, access to the Internet is provided via a Wi-Fi network using an IEEE 802.11 standard (unless otherwise noted). To access the Service at a particular hotspot location, you must use a device that is compatible with the specific Wi-Fi equipment deployed at that location. Availability and performance of the Service is subject to all memory, storage and other limitations in End User’s device.
The Service is intended for the limited purposes of allowing access to the public Internet for e-mail, web browsing, downloading files via the ‘ftp’ protocol typically implemented in such web browser programs, and for purposes otherwise consistent with the Terms of Service.
The Service is not intended for high-bandwidth applications, such as streaming of video programming.
Privacy and Security
While GOWEX strives to make the WE2 Network as secure as possible, wireless systems use radio channels to transmit voice and data communications over a complex network.
Privacy cannot be guaranteed, and GOWEX is not liable to the End User or any other party for any lack of privacy experienced while using the Service. GOWEX cannot guarantee that unauthorized third parties will not gain access to information regarding the type, conditions, and circumstances of your access to the Internet or intercept, eliminate, alter, modify or manipulate the contents or communications of any class that you may transmit, share, store, receive, obtain or gain access to through the Service. GOWEX is not liable for damages of any kind that may be incurred due to third parties’ knowledge of the class, conditions, characteristics and circumstances of the End User’s Internet use or which may be due to access and, as appropriate, the interception, elimination, alteration, modification or manipulation of the content and communications of all kinds that users may transmit, broadcast, store, make available, receive, obtain or access via the Service.
Modification and Cancellation of the Service GOWEX shall have the right to modify, suspend, or discontinue the Service at any time (or any function or feature of the Service or any part thereof) without prior notice to End User.
You agree that GOWEX is not liable to you or to any third party for any such modification, suspension, or discontinuance of the Service. You agree that GOWEX has the right to delete all data, files, passwords, or other information that resides or is stored on GOWEX’S hardware, if End User’s account is terminated or suspended for any reason. You agree that upon termination of this Agreement, you will immediately cease use of the Service and shall not continue use of the Service without express written consent of GOWEX.
Provisions in these Terms may be updated or changed from time to time. GOWEX will provide notice of changes in the Terms in any manner acceptable by law, including by posting them to our website at www.gowe2.com or at such other website as GOWEX may designate. Your continued use of the Service following updates or changes to these Terms constitutes your acceptance of such updates and changes. If you do not agree to the revisions, you must terminate your use of the Service immediately.
Operational Limits of the Service Provisioning of the Service is subject to the availability and the operational limitations of the requisite equipment, underlying broadband connection, and associated facilities. Service coverage, speed, and quality may vary. Your connection speed may not be suitable for some applications, particularly those involving real-time, or near real-time, high-bandwidth uses such as video streaming or video conferencing. You understand and agree that temporary interruptions to the Service may occur as normal events in the provision of the Service and that GOWEX will not be liable for such interruptions. You further understand and agree that in order to provide the Service, GOWEX relies on the existence of a workable broadband connection at the Merchant Venue based on a third party network over which GOWEX has no control, and therefore, delays and disruptions of such broadband connection or third party network transmissions are beyond the control of GOWEX. The Service is subject to unavailability, and GOWEX is not liable for any failure of performance and is not responsible for data, messages or pages lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Service. GOWEX may impose usage or service limits, suspend the Service, or block certain kinds of usage in its sole discretion to protect users, the GOWEX network, or the GOWEX business. Network speed is an estimate and is no indication of the speed at which your device or the Service sends or receives data. Actual network speed may vary based on device configuration, compression, distance, network congestion, interference and other factors. The accuracy and timeliness of data received is not guaranteed; delays or omissions may occur. GOWEX may, but does not have to, change or improve the Service.
Registration and Account Security
All information that you provide to GOWEX must be accurate, including your Facebook account login and password, name, email address, physical address, and any payment information (“Registration Data”). You will not use the Facebook account of anyone other than yourself without permission. You are responsible for keeping all Registration Data accurate and up-to-date and must promptly provide changes to GOWEX. You agree to keep confidential your login ID and password, and are solely responsible for any liability or damages resulting from your failure to maintain that confidentiality. You are also solely and fully responsible and liable for all activities that occur under your login ID. You will not let anyone else access your account or do anything else that might jeopardize the security of your account, and agree to immediately notify GOWEX if you suspect any breach of security, such as loss, theft, or unauthorized disclosure or use of your login ID or password.
By using your Facebook account information to login to the We2 Network, you agree to grant GOWEX access to your public information available on your Facebook profile, including username, legal name, profile photo, profile information, contact information, gender, friends list, contacts, and any information you make available to Facebook. Content Disclaimer: Cautions and Restrictions
GOWEX does not control, nor is responsible or liable for, the data, content, services, products (including software) functionality, utility, reliability, or accuracy of information that End User accesses, downloads, receives, or buys via the Service. The Service may be linked to other websites, which are not under GOWEX’s control. GOWEX may provide such links for End User’s convenience, and the inclusion of any link to such sites does not imply endorsement by GOWEX of those sites.
GOWEX may, but does not have to, block information, transmissions, or access to certain information, services, products, or domains to protect GOWEX’S network, the public, or other End Users; therefore, messages and other content may be deleted before delivery. The Internet contains unedited materials, which may be offensive and may not be in compliance with all federal, state, and local laws and regulations. GOWEX is not a publisher of third party content accessed through the Service and is not responsible for the content, accuracy, timeliness or delivery of any opinions, advice, statements, messages, services, graphics, data or any other information provided to or by third parties as accessible through the Service. End User accesses such materials at the End User’s own risk. You are responsible for paying all fees and charges of third party vendors whose websites, products, or services are accessed, bought, or used via the Service. If End User chooses to use the Service to access websites, services or content, or purchase products from third parties, End User’s personal information may be available to the third party. GOWEX has no responsibility for third party policies, or their compliance with them. If End User elects to download or otherwise enable any software via the Service, End User shall be solely responsible for, and shall be deemed to have reviewed, acknowledged, accepted or waived, any applicable disclosures, notices, or options otherwise made available to End User.
Interaction with Other End Users and We2 Merchants
You are solely responsible for all interactions you may have online or offline, if any, with other End Users and Merchants Venues. You are solely responsible for your conduct and any data, text, files, information, images, graphics, photographs, audio files, works or other content or materials that you submit, post or display via the Service. GOWEX does not control or direct End User’s actions while utilizing the Service and is not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may receive from other End Users or WE2 Merchants. You agree that GOWEX is not responsible or liable for the conduct of any End User or Merchant Venue.
Cooperation with Investigations.
GOWEX will cooperate with appropriate law enforcement agencies and other parties involved in investigating claims of illegal or inappropriate activity. GOWEX reserves the right to disclose End User information to the extent authorized by federal or state law. In those instances involving child pornography, GOWEX complies with all applicable federal and state laws including providing notice to the National Center for the Missing and Exploited Children or other designated agencies. You expressly authorize and consent to GOWEX cooperating with law enforcement authorities. GOWEX reserves the right to investigate suspected violations of its Acceptable Use Policy, including the gathering of information from End User and the examination materials on GOWEX’s servers and network.
Responsible use
GOWEX has a zero tolerance policy regarding use of the Service to engage in inappropriate conduct with a minor (anyone under 18 years of age). End User shall not knowingly collect or solicit personal information from a minor without the express consent of the parent or guardian of the minor, nor shall End User use the Service to harm or intimidate a minor.
GOWEX complies with all federal and state laws pertaining to the protection of minors. Upon accessing the Service you agree follow and abide by the GOWEX Acceptable Use Policy.
General Restrictions
Subject to your acceptance of and compliance with these Terms, you are hereby granted the right to use the Service through a non-exclusive, non-transferable, and non-assignable limited license. The Service is provided for your use only (unless otherwise specifically stated) and you agree not to reproduce, duplicate, copy, sell, transfer, resell or exploit for any commercial purposes your subscription to or membership in the Service, any portion of the Service, use of the Service, or access to the Service. You acknowledge that it is your sole responsibility for obtaining any such licenses. Any unauthorized use of any Materials provided with or through this Service may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. Except as expressly stated herein, you are not granted any intellectual property rights in or to the Service or Materials by implication, estoppel, or other legal theory, and all rights in and to the Service or Materials not expressly granted herein is hereby reserved and retained by GOWEX or the Third Party Provider.
Software Use
Any software that is made available to download with the Service (the “Software”) is the copyrighted work of GOWEX and/or Third Party Providers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (the “License Agreement”). End User will not install any Software that is accompanied by or includes a License Agreement, unless End User first agrees to the terms of the License Agreement. Except as set forth in the applicable License Agreement, any further copying, reproduction or redistribution of the Software is expressly prohibited.
Installation assistance, product support, and maintenance, if any, of the Software is available from GOWEX and/or the designated third-party.
EXCEPT AS SET FORTH IN THE LICENSE AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.
Unless otherwise explicitly stated, any Materials provided by you in connection with this Service shall be deemed to be provided on a non-proprietary and non-confidential basis.
GOWEX shall have no obligation of any kind with respect to such Materials and shall be free to use or disseminate such Materials on an unrestricted basis for any purpose. You acknowledge that you are responsible for the Materials that you submit, and you, not GOWEX, have full responsibility for the Materials, including their legality, reliability, appropriateness, originality, and copyright.
Disclaimer of Warranties
UNLESS OTHERWISE EXPLICITLY STATED, THE MATERIALS AND THE SERVICE ARE PROVIDED ON AN “AS IS” AND “WITH ALL FAULTS” BASIS AND ARE FOR PERSONAL USE ONLY. ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID. GOWEX MAKES NO REPRESENTATIONS, WARRANTIES, GUARANTIES AS TO THE QUALITY, SUITABILITY, TRUTH, ACCURACY OR COMPLETENESS OF THE SERVICE OR ANY OF THE MATERIALS PROVIDED WITH THE SERVICE. WE DO NOT GUARANTEE THAT THE SERVICE WILL ALWAYS BE SAFE, SECURE, OR ERROR-FREE OR THAT IT WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. ANY QUESTIONS REGARDING THE MATERIALS SHOULD BE DIRECTED TO THE PROVIDERS OF SUCH MATERIALS. HOWEVER, GOWEX DOES NOT AUTHORIZE ANYONE TO MAKE A WARRANTY ON GOWEX'S BEHALF AND YOU MAY NOT RELY ON ANY STATEMENT OF WARRANTY BY A THIRD PARTY AS A WARRANTY OF GOWEX.
Limitation of Liability
GOWEX SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGE ARISING USE OF THE SERVICE OR MATERIALS. MOREOVER, IN NO EVENT SHALL GOWEX BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, PERSONAL INJURY OR PROPERTY DAMAGES, LOSS OF PRIVACY OR SECURITY DAMAGES, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF BUSINESS, LOST REVENUE, LOST PROFITS, LOSS OF USE, LOSS OF DATA OR OTHER ECONOMIC ADVANTAGE) HOWEVER THEY ARISE, WHETHER FOR BREACH OR IN TORT, EVEN IF GOWEX HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR OTHER MODIFICATIONS OF OR LIMITATIONS TO CERTAIN REMEDIES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU, IN WHOLE OR IN PART.
Indemnification
You agree to indemnify and hold harmless GOWEX and its subsidiaries, affiliates, officers, agents, co-branders, licensors or other partners and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of any and all claims, demands, actions, liabilities, costs or damages arising out of your use of the Service or your violation of the Terms, Acceptable User Policy, or Privacy Policy.
Choice of Law/Venue
The laws of the state of New York, without regard to choice-of-law principles, govern all matters relating to, and the use of, the Service and the materials contained herein. The courts located in the state of New York are the exclusive venue for any and all disputes arising from the access or use of the Service.
